1. Acceptance of Terms
By downloading, installing, or using EchoDrop ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2. Eligibility
You must be at least 13 years of age to use EchoDrop. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's consent to use the App.
3. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:
- Provide accurate and complete information when creating your account
- Keep your login credentials secure and confidential
- Notify us immediately of any unauthorized use of your account
- Not transfer or share your account with any third party
4. User Content
4.1 Your Content
You retain ownership of all content you create, upload, or share through the App ("User Content"). By posting User Content, you grant EchoDrop a non-exclusive, worldwide, royalty-free, transferable licence to use, display, reproduce, distribute, and modify your User Content solely for the purpose of operating and improving the Service.
4.2 Content Standards
You agree not to post or share content that:
- Is illegal, harmful, threatening, abusive, harassing, defamatory, or hateful
- Contains sexually explicit material involving minors
- Promotes violence, discrimination, or illegal activities
- Infringes on the intellectual property rights of others
- Contains malware, spam, or deceptive content
- Impersonates another person or entity
- Violates the privacy or rights of others
4.3 Content Moderation
We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable, at our sole discretion. We may also suspend or terminate accounts that repeatedly violate these standards.
5. Tribes
If you create a tribe, you are responsible for managing its content and members. Tribe creators and administrators must ensure that tribe activity complies with these Terms. We reserve the right to remove tribes that violate our policies.
6. Prohibited Conduct
You agree not to:
- Use the App for any illegal purpose or in violation of any applicable laws
- Attempt to gain unauthorized access to other accounts, systems, or networks
- Interfere with or disrupt the integrity or performance of the Service
- Use automated scripts, bots, or scrapers to access the Service
- Collect personal information of other users without their consent
- Engage in any activity that could damage, disable, or impair the Service
- Circumvent any security features or access restrictions
7. Third-Party Services
EchoDrop may integrate with third-party services such as Spotify and Apple Music. Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the content, policies, or practices of third-party services.
8. On-Device AI Models
EchoDrop can optionally download artificial-intelligence models to your device to power private, on-device features such as content screening and insights. These models run entirely on your device; content they process for these features does not leave your device. Depending on configuration, one of these models may be a derivative of Gemma, which Google provides under the Gemma Terms of Use.
Gemma is provided under and subject to the Gemma Terms of Use found at ai.google.dev/gemma/terms.
If your installation uses a Gemma-derived model, the following terms apply to you and are incorporated into these Terms as an enforceable provision:
- You must not use the model, or any EchoDrop feature powered by it, for the restricted uses set forth in the Gemma Prohibited Use Policy, or in violation of applicable laws and regulations.
- A copy of the full Gemma Terms of Use is available at the link above and applies to the model and any derivatives of it.
Google claims no rights in outputs you generate using Gemma. You are responsible for outputs you generate using AI features and for their subsequent use, as set out elsewhere in these Terms.
9. Intellectual Property
The App, including its design, features, code, graphics, and branding, is owned by EchoDrop and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our written consent.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ECHODROP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.
12. Indemnification
You agree to indemnify, defend, and hold harmless EchoDrop and its affiliates from and against any claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service, your User Content, or your violation of these Terms.
13. Account Termination
We may suspend or terminate your account at any time if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to other users, us, or the Service. You may also delete your account at any time through the App settings.
14. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by posting a notice in the App or via email. Your continued use of the Service after such changes constitutes your acceptance of the updated Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which EchoDrop operates, without regard to conflict of law provisions.
16. Dispute Resolution
Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be submitted to binding arbitration in accordance with applicable arbitration rules.
17. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
